Takeoff‘s mother, Titiana Davenport, and estate sought dismissal of his rape accuser’s lawsuit over alleged text deletions after she sued, MyNewsLA reported. Their October 27 motion cited her October 14 deposition.
The woman, identified in court as Jane Doe, sued the Migos rapper in Los Angeles Superior Court on August 5, 2020. Her complaint accused him of sexual battery, assault, false imprisonment and inflicting emotional distress. The allegations concerned an Encino house party.
According to the complaint obtained by Rolling Stone, Doe had been in touch with DJ Durel, whose real name is Daryl McPherson, through social media before going to the party to meet him. She alleged that Takeoff’s repeated advances at the party had made her feel uncomfortable. The suit also alleged gender violence and civil rights violations.
Doe said she told Durel she did not want an intimate relationship with Takeoff. After an argument between the two men, she went to Durel’s bedroom. She alleged that Takeoff entered, ignored her refusal to have sex and raped her. The complaint placed the alleged assault at 2 a.m. on June 23. It also said she sought care at a hospital, where staff saw evidence of rape and notified police.
Her attorney, Neama Rahmani, told SPIN in 2020 that he normally would have waited for a criminal investigation to end before suing. He said more than a month had passed without an arrest or charges and hoped the lawsuit would bring forward witnesses and evidence. LAPD confirmed an active investigation to SPIN.
Takeoff denied the allegations through attorney Drew Findling, who told SPIN his team had reviewed them. Findling said: “What has become abundantly clear is that the allegations made against Takeoff are patently and provably false.”
In April 2021, the Los Angeles County district attorney’s office declined to prosecute because of insufficient evidence, a spokesperson confirmed to Pitchfork. Rahmani criticized that decision in a statement to the outlet and said Doe remained committed to her civil case. “She looks forward to receiving the justice she deserves in her civil case,” he said.
Takeoff was shot and killed in Houston on November 1, 2022. He was 28.
A hearing is set for January 21, 2027.
